These Terms & Conditions govern access to the Orika Jewels website and purchases made through it. Please read them before using the website or placing an order.
1. Business identity and definitions
The website https://orikajewels.com/ is operated by Orika Jewels, a sole proprietorship owned by Pravin Kumar, with its principal place of business at In Front of Bijlighar, Swarndham Colony, Sasni, Hathras, Uttar Pradesh 204216, India. In these Terms, ‘Orika Jewels’, ‘we’, ‘us’ and ‘our’ refer to that proprietorship; ‘customer’, ‘user’ and ‘you’ refer to a person accessing the website or placing an order; and ‘Site’ refers to the website and related online services.
2. Acceptance of terms
By accessing the Site, creating an account, submitting information or placing an order, you agree to these Terms and the policies incorporated by reference, including the Privacy Policy, Shipping Policy, Cancellation Policy, Return, Exchange & Refund Policy, Product Disclaimer and Grievance Redressal Policy. If you do not agree, do not use the Site.
3. Eligibility
The Site is intended for persons aged 18 years or older who are legally capable of entering into a binding contract. A person using the Site on behalf of another person or organisation represents that they have authority to do so. Orika Jewels currently sells through the Site for personal retail use within India and does not offer wholesale/B2B purchasing through the online checkout unless expressly agreed separately in writing.
4. Accounts
- You must provide accurate, current and complete account, billing and delivery information.
- You are responsible for protecting login credentials and for activity performed through your account, except to the extent caused by our breach or failure.
- Notify us promptly of suspected unauthorised access or incorrect account information.
- We may suspend or close an account reasonably suspected of fraud, abuse, unlawful activity, security risk or material breach of these Terms, while respecting applicable law.
5. Product information
We endeavour to present accurate product names, photographs, materials, plating, dimensions, price, availability, warranty and care information. Minor visual differences may occur for the reasons described in the Product Disclaimer. Customers should review the complete product page before ordering. Mandatory declarations on the product page, label or package form part of the product information.
6. Fashion jewellery and warranty
Unless expressly stated otherwise, products are fashion or imitation jewellery, not solid gold or investment products. Products are sold as anti-tarnish and carry a limited six-month anti-tarnish warranty subject to the Product Disclaimer, item-specific information, proof of purchase, proper care and inspection. Unsupported hypoallergenic, nickel-free or lead-free claims are not made for every product.
7. Prices and availability
- Prices are displayed in Indian Rupees. The total price payable and any applicable charge will be shown before order submission.
- Prices, offers and availability may change before an order is accepted.
- A genuine and obvious pricing, discount, stock or description error may be corrected. If it affects an order, we will inform the customer and offer confirmation at the corrected terms or cancellation with a full refund.
- Placing an item in a cart or wishlist does not reserve stock or price.
8. Orders and contract formation
Submitting an order is an offer to purchase. An automated order or payment confirmation only acknowledges receipt and does not by itself constitute final acceptance. The order is accepted when Orika Jewels sends dispatch confirmation or otherwise expressly confirms acceptance. This structure allows us to complete payment, fraud, address, stock and quality checks. We may reject or cancel an order before acceptance for the reasons stated in the Cancellation Policy.
9. Payment
Payment may be made using the online methods displayed at checkout or Cash on Delivery where available. Online payments may be processed through Razorpay, Cashfree, PayU, PhonePe or another displayed provider. You authorise the chosen provider and relevant financial institution to process the transaction. Orika Jewels does not intentionally store complete card or authentication credentials.
10. Cash on Delivery
- COD is available only for eligible orders, customers and serviceable PIN codes.
- The customer must provide accurate contact information and pay the amount due at delivery using the method accepted by the courier.
- Repeated refusal, false orders or abuse may result in COD restriction, account suspension or a requirement to prepay future orders.
- COD availability may be withdrawn before dispatch if order verification fails.
11. Shipping and delivery
Orders are subject to the Shipping Policy. Standard shipping within India is currently free, processing ordinarily takes one business day, and delivery is ordinarily expected within seven business days after dispatch. Timelines are estimates and may be affected by circumstances outside reasonable control.
12. Cancellation, returns, exchanges and refunds
A customer may request cancellation before dispatch without a cancellation charge. After dispatch, eligibility is governed by the Return, Exchange & Refund Policy. Eligible return requests must be submitted within seven days after delivery. Hygiene, personalisation and condition-based exclusions apply to change-of-mind returns but do not remove statutory remedies for defective, damaged, incorrect, counterfeit, unsafe or materially misdescribed products.
13. Promotions and coupons
- Unless the promotion expressly states otherwise, only one coupon or promotional code may be used per order and offers cannot be stacked.
- A promotion may have eligibility, product, minimum-spend, quantity, account, date or payment-method restrictions disclosed with the offer.
- Promotions may be modified or withdrawn before an eligible order is accepted, but changes will not retrospectively alter an accepted order.
- Coupons have no cash value, cannot be resold or transferred where prohibited, and cannot be applied after an order is placed.
- Fraud, duplicate accounts, automated misuse or manipulation may result in cancellation of the benefit and appropriate account restrictions.
14. Reviews and user content
If you submit a review, photograph, video, comment or other content, you confirm that it is truthful, based on genuine experience, lawful, non-infringing and does not contain confidential, defamatory, obscene, discriminatory, malicious or misleading material. Do not impersonate another person or submit a false review.
You retain ownership of your content but grant Orika Jewels a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt for formatting, display and use the content for website, customer-service and marketing purposes, subject to the Privacy Policy and any consent required by law. We may moderate or remove content that violates these Terms, but we are not required to publish every submission.
15. Intellectual property
The Site and its original text, graphics, logos, photographs, product presentation, design, software and compilation are owned by or licensed to Orika Jewels and are protected by applicable intellectual-property law. You may use the Site for personal shopping and information. You may not reproduce, scrape, republish, modify, sell, license, create deceptive copies of, or commercially exploit protected content without written permission, except as permitted by law.
16. Acceptable use
You must not:
- Use the Site for unlawful, fraudulent, abusive or deceptive activity.
- Interfere with security, access controls, servers, code, checkout, pricing or another user’s account.
- Upload malware, conduct automated scraping at harmful scale, attempt unauthorised access or test vulnerabilities without permission.
- Submit false information, payment disputes, return claims, reviews or grievances.
- Use Orika Jewels branding in a way that implies unauthorised affiliation, endorsement or resale.
17. Privacy
Personal data is processed according to the Privacy Policy. By using the Site, you acknowledge that service providers such as hosting, payment, courier, analytics, advertising and communication providers may process data as described there. Marketing consent may be withdrawn without affecting essential transactional communications.
18. Third-party services and links
The Site may depend on or link to independent payment gateways, couriers, social networks, plugins and other third-party services. Their separate terms and privacy policies may apply. Orika Jewels is responsible for its own obligations but does not control an independent third party’s systems, content or policies.
19. Disclaimers
The Site and products are provided subject to the express descriptions, warranties, policies and rights stated on the Site and under applicable law. We do not promise uninterrupted or error-free website operation, permanent product availability, identical screen colour or outcomes beyond an express warranty. Jewellery is decorative and does not provide medical, protective or investment benefits. Nothing in these Terms excludes an express representation or a statutory guarantee that cannot lawfully be excluded.
20. Limitation of liability
To the maximum extent permitted by law, Orika Jewels will not be liable for indirect, incidental or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence, fraud or wilful misconduct. For a claim arising from a specific order, liability will ordinarily be limited to the amount paid for the affected product, except where a higher or different remedy is required by law. This clause does not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, breach of non-excludable consumer rights, or any liability that cannot lawfully be limited.
21. Customer responsibility and indemnity
You are responsible for loss directly caused by your unlawful use of the Site, infringement of another person’s rights, fraud or material breach of these Terms. To the extent permitted by law, you agree to compensate Orika Jewels for reasonable direct losses and third-party claims resulting from such conduct. This clause will not apply to loss caused by Orika Jewels or to restrict consumer rights.
22. Force majeure
Neither party is responsible for delay or failure caused by events beyond reasonable control, such as natural disasters, epidemic, war, civil disturbance, government action, transport shutdown, courier disruption, power or network failure, cyberattack, labour disruption or supply interruption. Orika Jewels will take reasonable steps to communicate and mitigate the effect. Payment already collected for an order that cannot be fulfilled will be refunded as required by law.
23. Suspension and termination
We may suspend access or cancel an unaccepted order where reasonably necessary for security, fraud prevention, legal compliance or material breach. Where practical and lawful, we will provide notice and an opportunity to clarify. Termination does not affect rights or liabilities accrued before termination, including payment, refund, intellectual-property, privacy and dispute provisions.
24. Changes to the Site and Terms
We may update the Site, products, providers and these Terms. The current version will be posted with its effective date. Changes apply prospectively and do not remove rights arising from an order already accepted. Continued use after a change constitutes acceptance only to the extent permitted by law.
25. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any forum or jurisdiction available to a consumer under the Consumer Protection Act, 2019 or other applicable law, courts at Hathras, Uttar Pradesh will have jurisdiction over disputes. Before commencing formal proceedings, the parties are encouraged to use the Grievance Redressal Policy and attempt a good-faith resolution.
26. General provisions
- If a provision is held invalid or unenforceable, the remaining provisions continue to apply and the affected provision will be interpreted as closely as lawfully possible to its purpose.
- A failure or delay in enforcing a right is not a waiver of that right.
- You may not transfer an order, account or right under these Terms for commercial purposes without our written consent. Orika Jewels may transfer the business or its rights and obligations as part of a lawful restructuring, subject to applicable law.
- These Terms and the incorporated policies form the agreement for use of the Site and do not override item-specific terms or mandatory law.
